EasyStreet Acceptable Usage Guidelines

Please read these Guidelines, and the Services Agreement, carefully before opening or continuing an account with EasyStreet. By using EasyStreet services, you agree to comply with these Acceptable Use Guidelines. EasyStreet may terminate your EasyStreet account if you fail to comply with these guidelines. If you do not agree, please contact EasyStreet immediately.

Specific questions and/or suggestions concerning these Guidelines should be directed to EasyStreet Guidelines.

1.0 Required email account

EasyStreet communicates with customers primarily via email. You agree that sending a message to your contact email address is our agreed upon means of providing notification. You must maintain an up-to-date, valid email address on file with EasyStreet and check it routinely. This address is used to communicate vital information about your services, billing, service outages, and enhancements or changes to your existing services. This information is time-sensitive in nature. It is required that you read any email sent to your account to avoid any potential interruptions in your service. It is your responsibility for having an up-to-date, valid contact email address on file with EasyStreet. For those EasyStreet services containing a mailbox, we will assume this is your contact email address unless you tell us otherwise.

2.0 Use of individual/business dial-up accounts

Individual/Business dial-up accounts are for the interactive use of an individual connecting directly from a computer/modem to EasyStreet. You may stay connected as long as you are using your computer.

The unlimited Individual/Business dial-up accounts are not dedicated connection accounts. Individual/Business dial-up accounts may not run their own servers or programs which provide network services from these accounts. Examples of prohibited servers and programs include, but are not limited to, mail, web, and irc servers, and multi-user interactive forums. Users are also prohibited from running programs which keep their connection open without reasonable interactivity. Examples include, but are not limited to, using PING, keep-alive or email programs to keep the connection open while you are not actually at your computer. Our current inactivity timer is set to 20 minutes. There is a 6-hour maximum connection duration for non-LAN dial-up connections.

Each EasyStreet Individual/Business dial-up account includes one access account and one or more mailbox accounts. Each access account allows for a single modem connection at any particular time. Simultaneous connections from multiple computers is not allowed. It is the user's responsibility to ensure this restriction is enforced. Multiple simultaneous connections from a single access account may result in additional monthly charges and permanent deactivation of the account.

3.0 Usenet news use

When posting to newsgroups, you should comply with the newsgroup's written charter/FAQ. If a newsgroup does not have a charter or FAQ, its title may be considered sufficient to determine the general topic of the newsgroup. You should determine the rules of a newsgroup before posting to it.

Established Usenet conventions ("Netiquette") prohibit advertising in most newsgroups. EasyStreet users may post advertisements only in those newsgroups which specifically permit them in the charter or FAQ. Some newsgroups may permit "classified ads" for single transactions between private individuals, but not commercial advertisements. EasyStreet users are responsible for determining whether or not a newsgroup permits advertisements before posting.

Netiquette also prohibits certain types of posts in most Usenet newsgroups. Types of prohibited posts include chain letters, pyramid schemes, encoded binary files, job offers or listings, and personal ads. EasyStreet users may post these types of message only in newsgroups which specifically permit them in the charter or FAQ (if any). EasyStreet users are responsible for determining whether or not a newsgroup permits a type of message before posting.

EasyStreet users may not alter the headers of posts to newsgroups to conceal their email address or to prevent users from responding to posts.

Only the poster of a Usenet article, or EasyStreet, has the right to cancel the article. EasyStreet users may not use EasyStreet resources to cancel articles which they did not post. The sole exception to this rule is for moderators of formally moderated newsgroups; the moderator of a newsgroup may cancel any articles in a newsgroup he or she is moderating.

EasyStreet users may not attempt to "flood" or disrupt Usenet newsgroups. Disruption is defined as posting a large number of messages to a newsgroup which contain no substantive content, to the extent that normal discussion in the group is significantly hindered. Examples of disruptive activities include, but are not limited to, posting multiple messages with no text in the body, or posting many follow ups to messages with no new text.

4.0 Email policy

EasyStreet accounts may not send email to any user who does not wish to receive it, either at EasyStreet or elsewhere. EasyStreet recognizes that email is an informal medium; however, users must refrain from sending further email to a user after receiving a request to stop. EasyStreet will not forward mail of accounts terminated for bulk mailing or unsolicited advertising. EasyStreet has a zero-tolerance policy with respect to unsolicited email originating from accounts under our control. If mailings from your account generate EasyStreet abuse or spam complaints, you are liable for EasyStreet administrative charges up to $100 per complaint. If the mailing activity of an EasyStreet customer causes blacklisting of any EasyStreet services, the account may be disabled without notice.

Unsolicited advertising mailings, whether commercial or informational, are strictly prohibited. EasyStreet accounts may send advertising material only to addresses which have specifically requested it or "opted-in" to a list. Solicited bulk email is permitted provided the sender includes in the message: 1) a valid return/reply-to address, 2) an opt-out/unsubscribe option is clearly identified and 3) the recipient's email address must be included in the body of the message to allow for manual removal. Abuse/spam complaints about bulk messages not meeting these requirements are subject to a $100 abuse administrative fee per complaint. Mailings with more than 500 recipients are not supported using the EasyStreet mail servers. For mailings greater than 500 we recommend using your own mail server or a 3rd party bulk mail service.

Chain letters are unsolicited by definition and may not be propagated using EasyStreet services.

EasyStreet users may not send, propagate, or reply to mail bombs. Mail bombing is defined as either emailing copies of a single message to many users, or sending large or multiple files or messages to a single user with malicious intent.

EasyStreet users may not alter the headers of email messages to conceal their email address or to prevent users from responding to messages. A valid reply-to address is required.

Failure to abide by Netiquette sometimes results in massive numbers of email responses. If an EasyStreet user receives so much email that EasyStreet resources are affected, EasyStreet staff may shut down the user's mailbox.

For those EasyStreet accounts running their own mail servers, we require that you disable relaying. This ensures that your mail server will not become a relay source of unsolicited email. If unsolicited email passes through your mail server, the account may be deactivated and incur EasyStreet administration charges. There is a $100 charge for every five spam abuse complaints for each incident.

5.0 Access account bandwidth policy

EasyStreet accounts may not resell Internet access bandwidth.

As an ISP, our bottom line is determined by the amount of bandwidth our customers utilize. We have an official policy of Unlimited Bandwidth. You are not charged for the bandwidth you consume nor do we limit or have quotas on that bandwidth. However some services are designed for high-volume bandwidth while others support lower-volumes of traffic. If you are using an extreme amount of bandwidth on an inappropriate service, we retain the right to ask you to stop that service and request that you upgrade your account if necessary.

6.0 Abuse policy

EasyStreet assumes that you have enough technical knowledge to use your account without causing abuses. If your actions indicate that you are trying to crack, attack, block or intrude on the networks of EasyStreet users or those of other providers, we will deactivate your service and hold you liable for your actions. If activity from your assigned EasyStreet IP address generates EasyStreet abuse complaints, you are liable for EasyStreet administrative charges up to $100 per complaint.

As an EasyStreet user, if you become victim of attacks, we will help you in identifying the source. If you are hacked or have evidence of malicious behavior by another EasyStreet user we will be happy to contact the person for you and do whatever is necessary to prevent such activity. If the source is outside of EasyStreet, we can suggest how you should contact the appropriate source. Please send all notice and evidence of such abuse to EasyStreet Abuse.

As an EasyStreet user, if you are a source of attacks, this policy applies even to relatively harmless operations such as port scanning, and failed login attempts to other computers where you do not have official access. If your account is found responsible for such activity, you will receive a warning. If you receive 3 warnings your account will be deactivated, and any charges that are applicable will apply. (If you wish to play with security please use one of your own machines, or use other options such as the happyhacker.org web site.)

If your account is found responsible for actively committing malicious behavior (cracking machines, Denial of Service (DoS) attacks such as Ping of Death, SYN Flood, LAND Attack, IP Spoofing, etc) your account will be deactivated immediately.

If your account is used as a relay point for unsolicited or spoofed email your account will also be deactivated.

7.0 Non-commercial use

Some EasyStreet accounts, such as the Enthusiast DSL, are designated for non-commercial use. The access portion of these accounts must terminate at a non-commercial address. Web sites or other services on IP addresses of these accounts must be of a non-commercial nature. Selling of products, solicitations for business and/or exchange of funds or bartering are considered commercial uses. Domain names associated with these accounts must not be registered under company names. In questionable cases, EasyStreet's sole discretion will prevail.

8.0 Privacy

EasyStreet is committed to respecting your privacy. Once you choose to provide personally identifiable information, it will only be used in the context of your customer relationship with EasyStreet.

EasyStreet uses your information to better understand customer needs and continuously improve the level of service provided. Specifically, your information is used to help complete a transaction, to communicate back to you, to update you on service and benefits. Credit card numbers are used only for payment processing and are not utilized for other purposes.

EasyStreet will not give, sell, rent, or lease your personally identifiable information to others unless required by law or your prior permission is obtained.
